What is your contingency fee? Is this like a retainer fee?

A contingency fee is the amount of a final settlement that an attorney takes at the end of the case. This is the "we don't collect unless you win" statement that you hear in commercials. My contingency fee is 33.3% in personal injury cases and 40% in malpractice cases.

How much participation should the client expect in the lawsuit?

A client should feel assured that their case is being properly handled. Aside from discussing settlement proposals, preparations for hearings and depositions, and court appearances, a client should involve themselves only as much as they are comfortable participating. They should feel like the pressure to navigate their case is off of their shoulders when they hire their attorney.

How would we know that you are giving a case the necessary dedicated time?

Unlike other settlement mills in town, you will get personalized, dedicated, and responsive attention throughout the process. Once common lament is that clients can never get a hold of their attorney. I make it my promise to always try to get back to clients the same day, but never later than 24 hours. I am always available for an appointment to discuss the status of your case and will periodically provide updates. No decisions or settlements are made without first thoroughly discussing them with the client.

Will there be any advanced case costs at all if there is a loss?

I always work with my clients to ensure the fairest outcome is reached. If a client ends up taking a loss on their share of recovery, I will certainly offset those by taking a reduction in my fees. If the case is shaping up to end up in a total loss, I will have that conversation well in advance to discuss the risks and possible outcomes.

Also, costs of litigation are sometimes funded. These include costs of obtaining medical records, review of the records, depositions, mediation, and expert costs. If I front costs, it will be up to a certain limit and those will be reimbursed out of the total recovery.
